I have been diagnosed with ABC, Can I get benefits?

Just because you have been diagnosed with a major impairment, does not always mean that you will instantly qualify for disability benefits.

There are a multitude of impairments that can be incredibly disabling and life threatening.  However, the Social Security Administration does not always identify these impairments solely on the label.  They look deeper and so should you.

At the Berkley Law Firm, our mission is to show Social Security the severity of your impairments and how they affect you daily.  Don't let Social Security bully you by telling you that you are not disabled.  If you believe you can no longer work, contact our office now for more information.

Over 50 and Disabled?

Disabled people over the age of 50 have a higher success rate in obtaining Social Security Disability Claims. In fact, the Society of Actuaries has done a study that shows that while more than 44.1 percent of people aged 24 recover from their disability, only 11.8 percent of people aged 55 recover.

For individuals over the age of 50, it is sometimes more difficult to adapt to a new job situation and applicants may simply not have the necessary skills. This is especially true when a physical laborer becomes limited to sedentary work, but does not have the requisite skill-set for an office job. If you are over the age of 55 and cannot perform anything other than light work and have no transferable skills, you are more likely to obtain a favorable benefits resolution.

I'm Frustrated, I'm Tired and I Can't Do It Any Longer

Pursuing your claim for disability benefits is a long, repeat long process.  Giving up and throwing in the towel is exactly what the government wants you to do.

Lets think about this, if someone who is 45 years old applies for disability benefits and has a projected disability payment amount of $1500/month, that means that it will cost our government $18,000 a year to keep him on disability.  Lets further assume that this person would have regularly retired at age 65, that means it will cost our government 20 years of disability payments or a total amount of $360,000.  This figure does not take in to account other social services that this person may be eligible for.

At the end of the day, its a money issue for our government.  Many people die or come close to dying while waiting for their benefits they so badly deserve. Fight long and hard for everything that you deserve. Do not be deterred when you receive the initial denial from Social Security, fight back.
